This Proposed Parenting Plan is submitted as Exhibit A to Petitioner’s Request for Order for Temporary Custody Orders. It is offered as Petitioner’s proposed framework for the Court’s consideration and as a starting point for mediation ordered by the Court.
1. LEGAL CUSTODY
The parties shall share joint legal custody of both minor children, Sofia Lopez and Mateo Lopez. Joint legal custody means that both parents share equal authority and responsibility for major decisions concerning the children’s health, education, and general welfare. Each parent is authorized to make routine day-to-day decisions during their respective parenting time.
Decision-Making Protocol — Deadlock: If the parties are unable to agree on a major decision after a good-faith discussion (minimum 72-hour notice and deliberation period), either party may request a single mediation session with the Family Court mediator assigned to this case before seeking court intervention, except in medical emergencies.
2. PRIMARY PHYSICAL CUSTODY AND BASE SCHEDULE
Primary Physical Custody: Petitioner Elena Lopez shall have primary physical custody, with the children residing at the family home in Chula Vista as their primary residence.
Base Parenting Schedule — Week-On / Week-Off Rotation:
The parties shall follow a week-on / week-off custody rotation, with transitions occurring at school drop-off on Monday mornings (or Sunday at 6:00 p.m. when school is not in session).

Transition Location: School drop-off at [Fictional Elementary School], Chula Vista, on Monday mornings. When school is not in session, exchange shall occur at the family home (Petitioner’s residence) at 6:00 p.m. on Sunday.
Respondent’s Travel Weeks: When Respondent has a confirmed business trip during his parenting week that requires him to be absent for more than two consecutive nights, he shall notify Petitioner at least seven (7) days in advance (or as soon as practicable upon learning of the trip), and Petitioner shall assume care of the children during the absence. Respondent may make up the missed time by mutual agreement.
3. WEDNESDAY DINNER VISITS
During Petitioner’s parenting weeks, Respondent shall have a mid-week dinner visit with both children on Wednesday evenings from 5:30 p.m. to 8:00 p.m. Respondent shall pick up the children from school (or from Petitioner’s home if school has ended) and return them by 8:00 p.m.
During Respondent’s parenting weeks, no Wednesday visit by Petitioner is required, as the children are already in Respondent’s care.
4. HOLIDAY AND SCHOOL BREAK SCHEDULE
The holiday schedule below supersedes the regular week-on/week-off rotation. Times are 9:00 a.m. to 6:00 p.m. unless otherwise noted (overnight visits follow the rotation unless modified below).

Children’s Birthdays:
- Sofia’s birthday — Petitioner in even years; Respondent in odd years. The non-custodial parent shall have a separate 2-hour birthday celebration within the same week by mutual scheduling.
- Mateo’s birthday — Respondent in even years; Petitioner in odd years. Same makeup provision applies.
5. EXCHANGE LOGISTICS
School-Day Exchanges: On school days, the exchange shall occur via school drop-off and pick-up. The departing parent shall ensure the children are at school on time; the arriving parent shall pick up the children at the school’s normal dismissal time.
Non-School-Day Exchanges: Exchange shall occur at the family home (Petitioner’s residence at [Fictional Address], Chula Vista). Neither parent shall arrive more than 10 minutes early or depart more than 20 minutes late from the agreed exchange time without advance notice.
Travel With Children: Neither parent shall take the children outside the State of California for more than 5 consecutive days without 30 days’ advance written notice to the other parent and mutual agreement (or court order if agreement is not reached).
Emergency Contact: Each parent shall provide the other with a current cell phone number, address, and the name and contact of any individual with whom the children will be spending significant time during their respective parenting weeks.

7. COMMUNICATION PROTOCOL
Platform: Both parties agree to use OurFamilyWizard (or a comparable court-approved co-parenting communication platform) as the primary channel for all co-parenting communications. The parties shall respond to messages within 24 hours on business days and 48 hours on weekends.
Tone: All communications shall remain respectful and child-focused. Neither parent shall communicate negative statements about the other parent to the children or in the children’s presence.
Direct Communication with Children: Each parent shall have the right to speak with the children by video call or phone call once per day during the other parent’s parenting time, at a mutually convenient time (suggested: 7:00–8:00 p.m.). The custodial parent shall ensure the children are available and that the call is not interfered with.
8. MODIFICATION
This Parenting Plan is proposed as a temporary order pending final judgment. Either party may seek modification upon a showing of changed circumstances. The parties are encouraged to resolve modifications through the court-ordered mediator before filing a formal motion.
