Juan Cruz, Lucia Cruz
Defendant
Bright Horizon Property Management LLC

Fact pattern

Juan and Lucia Cruz have rented a two-bedroom apartment in the Pico-Union neighborhood of Los Angeles since March 2022. In January 2025, they discovered significant mold growth along the interior walls of the master bedroom, which they attribute to a persistent water intrusion issue they had reported informally to building management several months earlier. Simultaneously, the central HVAC unit serving their unit ceased functioning, leaving the family without heat during winter months and without cooling as temperatures rose in the spring. The Cruz family includes two minor children, ages four and seven, both of whom subsequently developed respiratory symptoms that their pediatrician documented in writing.

Over the following eleven months, the Cruz family submitted multiple written repair requests to Bright Horizon Property Management LLC, sent certified letters, and ultimately facilitated a Los Angeles Housing Department inspection in September 2025. The inspection resulted in an official notice of violation being issued to the property owner, citing mold remediation requirements and HVAC repair obligations. Despite that governmental notice, Bright Horizon made only superficial cosmetic repairs and did not address the underlying water intrusion. Throughout this entire period, the Cruz family paid their rent in full and on time each month.

After retaining legal counsel in late 2025, plaintiffs served a formal demand letter on Bright Horizon requesting immediate remediation, reimbursement of out-of-pocket medical expenses for the children, and a retroactive rent reduction reflecting the diminished value of the uninhabitable conditions. Bright Horizon did not respond substantively to the demand letter.

Procedural posture

The complaint was filed in Los Angeles County Superior Court in February 2026, asserting causes of action for breach of the implied warranty of habitability, negligence, and violation of Los Angeles Municipal Code habitability provisions. Defendant filed a demurrer to the first cause of action in March 2026, arguing that the complaint fails to allege with sufficient particularity which lease provisions were breached. Plaintiffs are currently preparing their opposition to the demurrer and anticipate the hearing will be scheduled within the next thirty days.
