When it's used
During the discovery phase after written discovery is underway and the attorney is ready to conduct oral examination.
Definition
A deposition notice is the formal document that sets the date, time, location, and scope of an oral examination of a party, party-affiliated witness, or third party under oath, pursuant to California CCP §2025.220. For depositions of parties, service of the notice alone is sufficient; for non-parties, a deposition subpoena must accompany it. The paralegal drafts the notice to include all required elements—the deponent’s name and title, the date and address of the deposition, the identity of the court reporter and any videographer, and any document demands under CCP §2025.220(a)(6)—then serves it with the required advance notice period (generally ten days for parties). Coordinating deposition logistics, ordering transcripts, and maintaining a deposition schedule are core paralegal responsibilities that keep the discovery process on track.
