Request for Order (FL-300)

Filed whenever a party needs a court order on custody, visitation, support, or property control during the proceeding.

Definition

A Request for Order on Judicial Council form FL-300 is the primary motion vehicle in California family court for obtaining judicial orders on child custody and visitation, child and spousal support, attorney fees, property restraints, and other relief during a pending dissolution or parentage case. The form must be accompanied by a supporting declaration, the most recent FL-150, and any other evidence the moving party relies upon, then served on the other party with adequate notice before the hearing. The paralegal prepares the FL-300, drafts the supporting declaration from the client’s factual account, assembles the exhibit package, coordinates service, and calendars the hearing date and any response deadline. Because RFO hearings often result in temporary orders that persist for months while the case develops, the quality of the moving papers directly affects the client’s situation during a critical period of the matter.
