Definition
A custody parenting plan is a comprehensive document that specifies how parents will share physical custody (where the child resides on a day-to-day basis) and legal custody (decision-making authority over education, healthcare, and religion) of their minor children, governed by California Family Code §3040–§3048, which directs courts to prioritize the child’s best interest. The plan addresses the regular weekly schedule, holiday and vacation rotations, pick-up and drop-off logistics, communication protocols between households, and procedures for resolving future disputes. The paralegal drafts the plan from the client’s proposed schedule, reviews it against applicable Family Code standards and any existing court orders, and prepares it either as a stipulation for both parties to sign or as a proposed order for the court to consider at hearing. A detailed and unambiguous parenting plan reduces post-judgment conflict by eliminating the gaps and ambiguities that generate enforcement disputes.
